Terms for Notenity’s paid App Store download, your local notebook and support from Dreamsnity.

1. About these terms

These terms concern Notenity, a paid note-taking app provided under the Dreamsnity brand. “Dreamsnity”, “we”, “us” and “our” refer to the app developer identified as the provider on the relevant App Store listing. You can contact us at dreamsnity@gmail.com.

Read these terms and the Notenity privacy policy before using the app. The software licence and App Store purchase rules described below apply to your download. These supplemental terms apply where they have been validly made part of your agreement; publishing a page does not by itself change an earlier purchase.

Nothing in these terms takes away rights that consumer, privacy or other applicable law does not allow a contract to exclude, including any right to a product that meets its description or an available repair, replacement, price reduction, refund or other mandatory remedy.

2. Your App Store licence

A copy of Notenity obtained through the App Store is licensed to you under Apple’s Standard End User License Agreement unless the App Store supplies a custom licence for your purchase. That licence governs the software licence, permitted use, applicable warranty terms, termination and limits of liability. This page supplements the applicable licence; it does not replace it or grant ownership of the software. If a supplemental term conflicts with that licence on a licensing matter, the licence controls, subject to mandatory law.

Use, permitted copies, transfers and any available Family Sharing are governed by that licence and Apple’s usage rules. Rights granted by applicable open-source licences remain with the relevant components.

Dreamsnity is the contact for Notenity’s app support. Apple handles its own store and billing services. The allocation of responsibilities in the applicable App Store licence continues to apply.

3. Who may use Notenity

You must have the legal capacity to agree to the terms that apply to your use. If local law requires a parent or guardian’s permission, obtain that permission before using the app. When using Notenity for an organisation, you must have authority to do so. Comply with applicable laws and the App Store requirements that apply to you.

4. Your notes belong to you

You retain the rights you hold in your notes, recordings and other content. Using Notenity does not transfer ownership of that content to Dreamsnity. You are responsible for having the rights and permissions needed to create, import, record, use or share it.

Notenity processes your notebook on your device to provide the features you choose, as described in the privacy policy. Dreamsnity does not receive your notebook through normal app use. If you choose to send content to support, you permit its use to investigate and respond to that request; this does not authorize selling it, public promotion or model training.

5. Recording responsibly

Before recording another person, obtain all consent required by the law and the circumstances. Recording rules can depend on where you and the other participants are located. A microphone permission on your device is not consent from another person.

Do not use Notenity for unlawful surveillance, harassment, impersonation, infringement of intellectual property or breaches of confidentiality. You are responsible for checking that your recording and sharing activities are lawful.

6. Acceptable use and our intellectual property

Use Notenity lawfully. Do not introduce malicious code, interfere with the app or related systems, seek unauthorised access, bypass access or payment controls, or use the app to violate another person’s rights. Restrictions do not prohibit activity that applicable law expressly permits despite a contractual restriction.

Dreamsnity and its licensors retain rights in the app’s software, design and brand assets. Except as allowed by the applicable licence or law, you may not redistribute, sell, sublicense or commercially exploit those materials. Your own content remains yours.

7. App Store purchases and refunds

Notenity is offered as a paid App Store download. The applicable price, currency and tax information are shown by the App Store before you confirm the purchase. Notenity currently has no in-app purchases or recurring subscriptions.

Your purchase provides the app licence and functionality described for the purchased app, subject to the stated device and feature requirements. It does not by itself include other Dreamsnity apps, separately offered products, custom development, a cloud storage service or a promise of every future feature. Updates and ongoing obligations remain governed by your purchase terms, the applicable licence and mandatory law.

Apple processes App Store billing. Requests to refund an Apple-billed purchase should use Apple’s refund process; eligibility depends on the transaction, Apple’s applicable rules and your statutory rights. Dreamsnity cannot guarantee Apple’s decision or change Apple’s billing records. You can still contact us about an app fault or another remedy for which we are responsible.

8. Your device, backups and important information

Your notebook is stored on your device. Dreamsnity does not operate a cloud notebook or remote recovery service. The app marks its managed notebook storage to be excluded from automatic operating-system backup. Maintain and verify exported backups, especially before changing devices, deleting data or uninstalling. Exported backups are not password-encrypted by Notenity.

Protected originals, safe-save recovery and previous-restore copies are local recovery aids. They do not guarantee recovery from device loss, damage, a failed export or every type of corruption. Keep an independent copy of important information. Protected originals and other recovery copies may remain after a visible note is deleted; use the relevant controls described in the privacy policy and separately manage exported copies.

Check transcription, handwriting recognition, translation, smart-writing suggestions and calculations before relying on them. Output may be incomplete or incorrect. Reminders depend on your confirmed dates, device settings and iOS delivery; location labels are approximate references. These features should not be your sole record or safeguard for an emergency, critical deadline or decision requiring professional advice.

Device, operating-system, language and model requirements can affect feature availability. On-device generative features require Apple’s supported system model; Notenity does not provide a cloud AI fallback. Your statutory rights continue to apply.

9. Third-party services

Apple and any external service you choose, including a file destination, calendar provider or linked website, operate under their own terms and privacy information. You choose which external destinations receive content you export or share. Dreamsnity does not control those recipients, their copies of your files or their service availability.

Our responsibility is limited to our own app and conduct, together with any responsibilities the law assigns to us for a provider we use. A link or compatible export destination is not a guarantee about an independent service.

10. App changes and ending use

We may release updates for security, maintenance, compatibility or product improvements. A purchase does not promise support for every future device or operating-system version, a particular future feature, or a fixed support-response time unless expressly stated at purchase. This does not remove updates, support or other obligations required by the applicable licence or law.

Material changes remain subject to the rights attached to your purchase. These terms do not give us a general right to remove paid functionality or withdraw a required remedy simply by changing this page.

You can stop using Notenity at any time. There is no Notenity account or subscription to cancel. Export content you want to keep before deleting it or uninstalling. Licence termination and any continuing rights are governed by the applicable App Store licence; ending use does not transfer ownership of your content to Dreamsnity.

11. Warranties and service limitations

Notenity must meet any binding description, express purchase commitment and mandatory product standard that applies to it. Beyond those commitments, we do not promise uninterrupted operation, perfect recognition or generated output, compatibility with every workflow, or successful recovery of every file.

The warranty exclusions in the applicable App Store licence apply where legally effective. General product information or a support suggestion does not, by itself, create an additional performance guarantee. This does not override a statement or promise that the law makes binding.

12. Responsibility and limits of liability

For claims covered by the applicable App Store licence, its exclusions and any aggregate financial limit apply where legally enforceable. These supplemental terms do not increase those limits or create a second recovery for the same loss.

If you use Notenity for business purposes, Dreamsnity excludes liability for loss of business profit, business interruption and indirect business losses where that exclusion is lawful. This does not exclude a consumer remedy for defective digital content or reasonably foreseeable loss where the law makes us responsible. We are not responsible for loss to the extent it is caused by unlawful misuse, disclosure to a recipient you choose, or an event outside our reasonable control, rather than a breach of a duty we owe you.

No limitation in this page excludes fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or other liability where exclusion or limitation is prohibited. Mandatory consumer remedies and data-protection rights remain available. If a limit cannot lawfully apply to a particular claim, the applicable legal rule governs that claim.

13. Questions, disputes and changes to these terms

For an app problem, contact dreamsnity@gmail.com with a description and relevant device and app-version information. Please avoid sending a complete notebook or sensitive recordings. We can discuss a support request without requiring you to give up a legal right.

The governing-law provisions of the applicable App Store licence apply within their stated scope. For any matter they do not address, applicable conflict-of-law rules determine the governing law. Mandatory consumer protections and the right to use a court or authority available under applicable law are preserved.

If a provision is unenforceable, the remaining provisions continue to apply where legally possible. A failure to enforce a provision on one occasion does not automatically waive it for the future.

The date above identifies this version. Material changes will be identified, with notice and agreement where required. New terms do not retrospectively remove rights attached to an earlier purchase.
